RETURN POLICY
This Refund Policy shall be applicable when you make any purchases on www.elyseclark.com/ (hereinafter referred to as the “Website” or “Site”). Please read this Policy carefully, as it forms a binding agreement between you and Elyse Clark Photography. If you do not accept this Policy in its entirety, then you may not place orders with us. This Policy shall be read in conjunction with our Terms & Conditions and our Privacy Policy statement.
By placing an order with us you hereby represent that you have read, understood, and agreed to be bound by this Policy.
1. ACCEPTANCE OF THIS POLICY
By placing an order with us you hereby represent that you have read, understood, and agreed to be bound by this Policy.
2. DESCRIPTION
We use our best endeavor to provide accurate and materially complete description of all the artwork, photos and products listed on our website. However, we do not warrant that such description will always be accurate, complete, reliable, current or error-free. We reserve the right to make corrections and modifications in such description.
3. PRICING DISCLAIMER
We aim to provide accurate and up-to-date pricing information with respect to the products listed on the Site. We cannot, however, warrant against pricing errors. Elyse Clark Photography reserves the right, at its sole discretion, to not process or to cancel any orders placed for a product whose price was incorrectly posted on the Site as a result of any error. If this occurs, we will notify you by email or other written communication. Besides this, Elyse Clark Photography reserves the right, at its sole discretion, to correct any error in the stated retail price of the concerned product. We may also update the prices of our products, from time to time, at our sole discretion.
4. CANCELLATION
a) Cancellation: Placed your order by mistake? Don’t worry, you are entitled to cancel your order within a period of 24 hours from the time you placed an order. Cancellation is free. To request a cancellation within this time frame, please contact us at hello@elyseclark.com. Please note, you cannot cancel or make any changes to your order after 24 hours have lapsed from the time you placed an order. b) Refunds for Cancelled Order: Once you cancel your order within 24 hours, the actual amount that you paid for the cancelled product will be credited back to your original method of payment within a period of 5-7 working days.
5. REFUNDS
a) Every product sold on www.elyseclark.com/ is “made to order”, which means it is specifically manufactured just for you after you have placed your Order with us. Accordingly, we DO NOT accept any returns or exchanges or refund request for any order. You may cancel the order as per Section 4 above. b) On rare occasions, one or more products in an Order may be damaged while in transit in possession of our shipping partners. If one or more of your product(s) arrives damaged, please send detailed, clearly visible photos of the damage including images of the packaging to hello@elyseclark.com. c) In cases where one or more product(s) is materially damaged, we may elect to restore or replace the damaged product(s) in our sole discretion following a review of the photos submitted (“Damage Review”). If requesting a Damage Review, you expressly acknowledge and agree to the following: 1) photos of damaged areas of product(s) must be clearly visible and submitted in .jpeg or .png format; 2) photos of damage must be received no fewer than seventy-two (72) hours following the indicated delivery date of the applicable Order by the shipping provider responsible for delivering the Order; 3) photos of the damage must have been taken immediately following receipt of the product(s), and the product(s) must not have been hung, placed or otherwise installed prior to photos of the damage being taken; 4) a Damage Review requires a minimum of thirty (30) business days to complete, and Spoils may elect to replace or repair the damaged product in its sole discretion; and 5) the delivery of a replacement product, if any, will be subject to then existing manufacturing capacity, inventory, availability and shipping timing, and you may be responsible for payment of return shipping in the event elects to repair or replace the product(s). d) In case of your return request acceptance, and after we have received your unused product, we will examine the product. It is only upon our satisfaction of the you meeting all the conditions of the return, that you would be entitled to a refund. In case of damaged products, your refund will be credited to your original method of payment within a period of 5 – 7 working days from the date we finally accept your request. Moreover, in case of refunds, only the actual amount paid to us by you for the product at the time of checkout will be refunded.
6. GOVERNING LAW AND DISPUTE RESOLUTION
In case of any claims, disputes or controversies arising out of or in relation to the services, or this Policy, the same shall be dealt with as per the Governing Law and Dispute Resolution clause as mentioned in the Terms & Conditions.
7. UPDATES TO THIS POLICY
We may add to or change or update this Refund Policy at any time, from time to time, entirely at our own discretion, with or without any prior written notice. You are responsible for checking this Policy periodically. Your use of the website after any amendments to this Policy shall constitute your acceptance to such amendments.
